These Terms of Service (“Terms”) govern all sales, deliveries, pickups, and transactions conducted by Badger Turf Supply, LLC (“Company,” “we,” “our,” or “us”). By purchasing products from Badger Turf Supply, LLC, the customer (“Customer,” “you”) agrees to the following terms.
1. Payment Terms
- Payment is required in full (100%) at the time of delivery or pickup.
- Accepted payment methods may include cash, check, credit card, or other approved forms of payment.
- The Company reserves the right to withhold product release until full payment has been received.
- Any returned checks or failed payments will be subject to additional fees and may result in suspension of future purchasing privileges.
2. Pricing & Quotations
- All pricing is subject to change without notice.
- Quotes are valid for the time period specified on the quote; if no time is specified, quotes are valid for 7 days.
- Prices do not include delivery fees, taxes, or additional services unless explicitly stated.
3. Orders & Availability
- All orders are subject to product availability.
- The Company reserves the right to cancel or modify orders due to inventory limitations, pricing errors, or unforeseen circumstances.
- Customers are responsible for verifying order quantities, specifications, and materials at the time of purchase.
4. Delivery & Pickup
- Delivery dates and times are estimates and not guaranteed.
- The Customer is responsible for providing safe and reasonable access to the delivery site.
- The Company is not responsible for damage to driveways, sidewalks, or job sites unless caused by gross negligence.
- Risk of loss transfers to the Customer upon delivery or pickup.
5. Inspection & Acceptance
- Customers must inspect all products upon delivery or pickup.
- Any shortages, defects, or damages must be reported immediately at the time of receipt.
- Claims made after acceptance may not be honored.
6. Returns & Refunds
- All sales are final unless otherwise agreed to in writing.
- Returns may be accepted at the sole discretion of the Company and may be subject to restocking fees.
- Custom orders and cut materials are non-refundable.
7. Warranty Disclaimer
- See specific warranties for turf – most artificial grass is has a limited 15 year warranty, otherwise products are provided “as is” unless otherwise specified.
- The Company makes no warranties, express or implied, including but not limited to warranties of merchantability or fitness for a particular purpose.
- Installation methods, site conditions, and maintenance practices are beyond the Company’s control and are the responsibility of the Customer.
8. Limitation of Liability
- The Company shall not be liable for any indirect, incidental, or consequential damages.
- The Company’s total liability shall not exceed the purchase price of the products supplied.
9. Indemnification
- The Customer agrees to indemnify and hold harmless the Company from any claims, damages, or liabilities arising from the use, installation, or resale of the products.
10. Wholesale Use
- Products are intended for professional, contractor, or wholesale use.
- The Customer assumes responsibility for proper installation and compliance with all applicable codes and regulations.
11. Governing Law
- These Terms shall be governed by and construed in accordance with the laws of the State of Wisconsin.
- Any disputes shall be resolved in the courts located within Wisconsin.
12. Modifications
- The Company reserves the right to update or modify these Terms at any time without prior notice.
- Continued business with the Company constitutes acceptance of any revised Terms.
